Using the Move Goose website

Terms and Conditions.

These terms explain the rules that apply when you use the Move Goose website, request a moving quote, communicate with us online or purchase services from us.

These terms govern the website. Your accepted quote governs the details of your move.

Move Goose provides quote-based moving services. The accepted quotation, proposal or service agreement may contain additional terms for a particular move, including the scope, date, access requirements, payment arrangements and other service-specific details.

01

Agreement and acceptance

These Website Terms and Conditions form an agreement between you and LAING VERVOER (PTY) LTD trading as MOVE GOOSE. By visiting or using this website, submitting a quote request, or interacting with our online services, you agree to be bound by these terms.

If you do not agree with these terms, please stop using the website.

Service-specific terms

Your move may also be governed by the quotation, proposal, booking confirmation or service agreement that you accept. Where a service-specific term conflicts with these general website terms, the more specific accepted term will apply to that service, except where applicable law requires otherwise.

02

Definitions and interpretation

In these terms:

  • “Content” means text, images, graphics, video, documents, data, software and other material made available through the website.
  • “Move Goose”, “we”, “us” or “our” means LAING VERVOER (PTY) LTD trading as MOVE GOOSE.
  • “Services” means moving, collection, delivery, transport and related services offered or supplied by Move Goose.
  • “Website” means this website and all pages, forms and online functions controlled by Move Goose.
  • “You” or “user” means any person who accesses the website, requests a quote or purchases Services.

Headings are included for convenience and do not affect interpretation. References to legislation include amendments, replacements and regulations made under that legislation. These terms are written in English, and the English version prevails if a translation differs.

03

Use and availability of the website

You may use the website only for lawful purposes and in a way that does not damage, disable, overload or impair the website, its systems or another user’s access.

You must not:

  • Attempt to gain unauthorised access to the website, server, account, database or connected system.
  • Introduce malware, harmful code or any material intended to disrupt or damage the website.
  • Scrape, harvest, copy or systematically extract website data, pricing, listings or Content without written permission.
  • Misrepresent your identity, authority, age, affiliation or relationship with Move Goose.
  • Use our name, logo or website in a false, misleading, defamatory or unlawful manner.

We take reasonable steps to keep the website available and accurate, but we may suspend, restrict, update or withdraw any part of it for maintenance, security, operational or other legitimate reasons without prior notice.

04

Quote requests, bookings and Services

A quote request submitted through the website, Typeform, email, WhatsApp or telephone is a request for information and is not, by itself, a confirmed booking or binding obligation on Move Goose.

A quotation is based on the information available when it is prepared. You are responsible for providing complete and accurate information about the move, including addresses, access restrictions, stairs, lifts, parking, inventory, unusually heavy or fragile items, preferred dates and any other factor that may affect the work.

A booking becomes binding only when the acceptance requirements stated in the quotation, proposal or booking confirmation have been met. These may include written acceptance, payment or another stated confirmation step.

We may decline a quote request or booking where we are unable to provide the requested Service, information is incomplete, the work presents an unacceptable risk, or another reasonable operational or legal ground exists.

Any estimated date, collection time, delivery time or duration is provided in good faith. Traffic, weather, access problems, breakdowns, delays at a property and circumstances outside our reasonable control may affect timing.

05

Pricing, payment and card security

The amount payable for Services will be stated on the applicable quotation, proposal, invoice or booking confirmation. Website information is general and does not replace a personalised written quotation.

Unless expressly stated otherwise, Move Goose is not registered for VAT and VAT is therefore not added to quoted prices.

You must pay amounts when and in the manner stated in the accepted quotation, invoice or service agreement. Charges arising from inaccurate or incomplete information, a changed scope, additional labour, waiting time or other requested work will be handled in accordance with the accepted service terms and applicable law.

Where card payments are offered, card details are processed by an external payment service provider in a secure environment and are not processed through pages controlled solely by Move Goose. Approved refunds will be made through an appropriate payment method, subject to the accepted service terms and applicable law.

06

Consumer rights and cancellations

Nothing in these terms is intended to exclude, waive or limit a right or remedy that cannot lawfully be excluded under the Consumer Protection Act, the Electronic Communications and Transactions Act or other applicable South African law.

Cancellation, postponement, rescheduling and refund arrangements for a booked move will be governed by the accepted quotation, proposal or service agreement, together with any rights that apply under law.

Where a statutory cooling-off or cancellation right applies, Move Goose will honour that right in accordance with the relevant legal requirements.

07

Your information and communications

You agree to provide accurate, complete and current information when requesting a quote, making a booking, submitting a form or communicating with us. We are not responsible for delays, additional work or other consequences caused by materially inaccurate or incomplete information.

Email, WhatsApp and other electronic communications may be used for quotations, confirmations, notices and service administration. You agree that an electronic communication can be contractually binding where applicable law permits it.

Personal information is processed in accordance with our Privacy Policy.

08

User submissions and prohibited Content

If the website allows you to submit reviews, comments, files, photographs or other Content, you remain responsible for what you submit.

You must not submit Content that is unlawful, malicious, defamatory, obscene, threatening, deceptive, infringing, discriminatory, harmful, sexually explicit, confidential without authority, or intended to impersonate another person.

You confirm that you own or are authorised to submit the Content and grant Move Goose a non-exclusive licence to store, reproduce and use it only as reasonably required to operate the website, respond to you, deliver the Services or publicise feedback where you have authorised publication.

We may refuse, edit or remove Content that breaches these terms or creates a legal, security or reputational risk.

09

Intellectual property

The website and its Content, including text, graphics, photographs, logos, icons, downloads, layout, data and software, are owned by or licensed to Move Goose and are protected by applicable intellectual-property law.

You may view and make a reasonable personal copy of website Content for your own non-commercial use. You may not reproduce, modify, publish, sell, distribute, exploit or use a substantial part of the website or Content without our prior written permission.

You may create a normal hyperlink to the website provided the link is lawful and does not present Move Goose, its Services or its relationship with you in a false, misleading, derogatory or offensive manner. You may not use our logo or proprietary graphics as part of the link without written consent.

10

Third-party services and external links

The website may use or link to third-party services, including Typeform, payment providers, maps, analytics tools, social platforms or other external websites.

Third parties operate under their own terms, security measures and privacy practices. Move Goose does not control external websites and is not responsible for their availability, content or independent conduct, except to the extent that applicable law provides otherwise.

A link, integration or reference does not necessarily mean that Move Goose endorses every statement, product or service offered by that third party.

11

Disclaimers, liability and indemnity

We make reasonable efforts to keep website information accurate and current. However, website Content is provided for general information and may contain errors, omissions or outdated information. It does not constitute legal, financial, technical or other professional advice.

To the fullest extent permitted by law, Move Goose does not accept liability for indirect, consequential or purely economic loss arising only from use of, or inability to use, the website or reliance on general website Content.

Nothing in these terms excludes liability for fraud, gross negligence, wilful misconduct, death or personal injury caused by negligence, or any liability that may not lawfully be excluded or limited.

Where liability may lawfully be limited, any website-related liability will be limited to the amount paid by you for the relevant Service during the 12 months immediately preceding the event giving rise to the claim, unless the accepted service terms or applicable law require a different result.

You agree to indemnify Move Goose against reasonable losses, claims, costs and expenses arising from your unlawful use of the website, breach of these terms, infringement of another person’s rights, or unauthorised Content submitted by you, except to the extent that the loss was caused by Move Goose.

12

Notices, disputes, force majeure and governing law

Notices may be delivered by hand, post or email to the most recent contact details supplied by the relevant party. Email notices are deemed received within 24 hours where no delivery-failure notice is received, subject to applicable law and evidence to the contrary.

If a dispute arises, the parties should first attempt to resolve it in good faith through direct engagement and, where appropriate, mediation before commencing arbitration or litigation.

Neither party will be liable for a failure or delay caused by circumstances beyond its reasonable control, including severe weather, road closures, labour disruption, utility failure, civil disturbance, government action or other force-majeure events.

These terms are governed by the laws of the Republic of South Africa. Subject to applicable consumer rights and jurisdictional rules, disputes will be dealt with in South Africa.

If a provision is found invalid or unenforceable, it will be reduced or severed only to the minimum extent necessary, and the remaining provisions will continue to apply. A failure to enforce a right immediately does not waive that right.

13

Changes to these terms

We may update these terms to reflect changes to the website, Services, business practices or legal requirements. The version published on this page applies from its stated update date.

Changes will not retrospectively alter the agreed price or core terms of a confirmed booking unless you agree, the accepted service terms allow it, or a change is required by law.
